Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Appfend platform, websites, and related services (the “Service”) provided by Appfend (“we”, “us”, “our”). By using the Service you agree to these Terms.

1. The service

Appfend provides hands-on, browser-based security training in real development environments, an AI tutor, reporting, and related features. We may update, improve, or change the Service from time to time.

2. Accounts and eligibility

You are responsible for the accuracy of account information and for activity that occurs under your account. You must keep your credentials secure and notify us of any unauthorised use.

3. Acceptable use

You agree not to misuse the Service. In particular, you will not attempt to access systems or data you are not authorised to access, disrupt the Service, or use lab environments to attack systems outside the training sandbox.

4. Customer content and custom labs

You retain ownership of code, materials, and content you submit to build custom labs. You grant us the limited rights needed to host and operate that content for the purpose of providing the Service. Lab environments are ephemeral and torn down at the end of a session.

5. Fees and payment

Paid plans are billed per the order or quote agreed with you. Fees are exclusive of taxes unless stated otherwise. Unless required by law, fees are non-refundable.

6. Intellectual property

The Service, including its software, content, and pre-built labs, is owned by Appfend and its licensors and is protected by intellectual property laws. These Terms do not transfer any of our intellectual property to you.

7. Confidentiality

Each party may receive confidential information from the other. The receiving party will protect it with reasonable care and use it only to perform under these Terms.

8. Warranties and disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms.

9. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages. Our total liability arising out of the Service will not exceed the fees paid by you in the twelve months before the event giving rise to the claim.

10. Term and termination

These Terms apply while you use the Service. We may suspend or terminate access for breach of these Terms. On termination, your right to use the Service ends.

11. Governing law

These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction over any dispute, subject to any mandatory local rights.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the date above. Continued use of the Service after changes take effect constitutes acceptance.
